i hav found, this usage does get audited.if Revenue assurance sees a whole lote of data being trasnfered they are not stupid. they can tell if this is from a phone or a full blown html sites. and possibly even contact you to change to a data plan or with out knoledge put you on a data plan. i dont htink thell put you on a 79.99 ulmited plan. if this has not happend if this trend cacthes on then trust me - thell be looking in to it.

They may look into it, but I don't see what right they would have in making you change to a data plan. You're not doing anything illegal. This is probably a lawsuit waiting to happen if what you say is true.

It might be against their 'terms of service' for that plan - in which case it's not illegal. I don't even know if it would be illegal otherwise. What law is it they would be breaking?

Unethical? Sure...but so is using the cheaper non-data plan as a data plan.

There are separate data plans for "Smart Phones" that are cheaper than the Data Connect Plans you are referring to. BUT If you want to use your phone as a modem for your laptop or PC you have to be on a data connect plan. I have actually tried doin that with media works and they have blocked it so you can't. It will only let you visit WAP sites. The other plans for Smart Phones and PDA's are commonly known as PDA connect. Whenever I sell a Treo, 6620 or an Mpx220 they get a PDA connect plan.

I'm not trying to be a dick, but what exactly did you tell us lostboyvall? Your original post implied that you could use a phone as a modem with a Media Plan, but Cingular would call you on it and force you to a Data Connect plan:

It just worked for me..Nokia 6620 connected to my desktop (via bluetooth) and I got online..real internet..with Media Works..

Ok then, being as this is the 17th different answer I've heard (read) regarding this issue, I'll repeat what I said earlier on another post, at this point I can't remember which one, but I'll have to see for myself. As soon as the S710a comes out, I'll try and use the phone as a modem with my laptop and see what kind of data rate I get with a Media plan, if I can connect at all.

I'm not saying any of you are wrong. All I know is that I've used my T637 as a modem with BT and IrDa with mMode (AT&T, cost me $20 to check my hotmail, I remember it distinctly b/c AT&T is a rip off charging $.03 per KB), and I was just interested in knowing if I could do the same with the S710a, but at EDGE speeds with a Cingular Media Plan(of course I'll be b...

I have a 6620, I have used my phone as a modem for my desktop (via bluetooth) and it works for the real internet..slow, but it works..and I have MediaWorks, not some data connect plan..

That's what I meant, I think; against the 'terms of service'. That came out wrong. If that is the case, then they have every right to force you to a data connect plan. If not though, it's their fault for being stupid and it's not unethical, in my opinion.
