Motorola V365

I have had the V365 for 2 months. The first one needed replaced after only 3 days, it wouldn't charge. Tried new chargers and new batteries to no avail, got it replaced fairly quickly. Now the 30 day replacement policy has expired and the phone is broken again. The display screen is cracked this time, aparently internally but visable thru the external pannel. I have not dropped or damaged the phone in any way. It worked last night. I made a call, closed the phone placed it in the console of my car. It stayed there all night (parked in heated garage, didnt freeze). This morning, it was cracked. Cingular says it's not a defect so it's not covered under warranty.
