Question about upgrading with the settlement lurking....

I am not sure if this was posted or not, I didn't see it in a search. I was wondering, if I decide to upgrade my phone before we receieve the return information, do I forfeit any money that was entitled to me through the class action?

I have had my phone since the day it came out, and it is coming towards the end. The battery sucks, the phone freezes, and I am just ready for a new phone. Will I be able to still take my phone back for a refund even after I upgrade to a new phone? The VX9800 is looking rather nice...

Any help will be much appreciated! Thanks

On the claim form it stated current or former customers of VZW were entitled to the settlement. I doubt very much that you would be excluded because you decided to upgrade your phone. Just make sure you hold onto your v710.

My V710 died and was replaced by Verizon with an E815. I called the Attornies for the law suit and was told that I was now ineligible for a settlement since Verizon took back the phone in exchange for the E815. You must have a V710 in order to exchange it in terms of the settlement.

Well, I could see how you would be ineligable because you would no longer possess a v710. But if I keep my v710, and just upgrade to a new phone, what happens when I go to return the v710? Do I have to use the credit I receive towards that phone right then and there... or do they give me like a voucher to come back at a later time and pick up a new phone? I just feel like I have held out this long without getting a new one. If we are going to possibly receive money in the next 90 days or so (providing no appeals) I don't want to lose out..
Im sure im not the only one in this position.

Yeah, I'm having some of the same problems with my phone. I'm sooooo frustrated everytime one of my friends with an LG phone takes a picture with their phone and it looks 20x better than when I take one with my v710. My battery lost its *umph* a long time ago and I sometimes have to charge the phone two times a day. I figure I can hold out with the phone for another 2 months when faced with the other option of signing a new contract and shelling out $$$ for another hot phone. I paid $349 for the v710 the day it came out and I opted for a the refund so I'll have plenty of options for new phones where I won't have to pay anything. 😉
