Any news on that V710 settlement?

I am one of the lead plaintiffs in Ohio filed Class Action which joined California case early this year. I just signed off the final proposed Settlement today. So, hopefully in next few months, VZW should have claim form mail out to all the customer who falls into the "Class Periods" which is before Jan. 1, 2005 who purchased V710.

There are three options:

a)$25 credit for the service.

b) returned v710 for full credit if you have receipt or $200 if not, continue vzw serice and purchase another phone with same price as if was new contract.

c) return v710 for full refund if you have receipt or $200 if not, cancel the service without cancelation fee.

For those of already cancelled service before the settlement, you will get your cancellation fee back.

Eligibility of the settlement is for those of you purchased v710 before 01/01/2005.

Thanks. Do you know how this credit is applied? Is it an accrued monthly refund/credit or something like that?

This is a one time credit if you chosing continue using the v710 and vzw services.

BTW, one correction to the eligibility date should be 01/31/2005, not 01/01/2005.

If this is true, it would seem like I can upgrade to e815, pocket at least $100 in cash, and seem edit to allow OBEX so it will actually work in my Toyota vehicle the way it should have worked on day one. I don't understand these edits well but I wonder why this was worked out for the e815 and still no OBEX on the V710. Someone could make a few bucks by offering their services to flash the phones to OBEX and sending them back. I paid someone $25 including return shipping to unlock my Motorola GSM phone and it was a good deal for all involved. I saw one e815 sold on ebay where the seller ofered to enable OBEX for free at the buyers request.

It is a good deal, and it was worth the work. I paid $339 for my V710 last August. Wonder what I should buy now?

Everywhere. Bear in mind, the settlement was not signed by the Judge yet, but the parties reached the agreement.

I have the 710, and am interested in upgrading to the 815, i believe i joined the class action suit, should i wait to get the 815 - seeing as though i may get money back? Does anyone know when this is supposed to go through?

Think of the V710 as a collectors item for right now, if you bought it from Verizon before 2/1/2005.

I don't mean to sound out of tune here but i think Verizon got of this a little easy i was reading the 3 options to choice from for the settlement and i think Verizon should have received a little bit more than a tap on the hand for this one.

Agreed. I think they should have re-wrote the software Bluetooth stack and allowed OBEX to be introduced into this phone. But I'm not totally disappointed with the fact that I'll trade in my v710 for the refresh of the e815.

I'm a bit out of the loop on this... I haven't been on Phone Scoop since buying the v710 a year ago (August 2004 on the first day it came out).

1. Do I need to do anything to be part of the Class Action?

2. What's the major diff. between the 815 and the 710? Is it just the OBEX cabability?

3. If I'm 1 year through my 2 year contract on the v710 - what's the best thing to do?

I received notice from those initiating the class action suit that there would soon be information (presumably the same provided here) at http://www.verizonwireless.com/V710Settlement .

Any word on when that site will be active?

Also, would there be any restrictions on the condition of the phone for the refund (I'd probably go with Option B)? My phone was damaged, and I had to Ebay a replacement (thought the V710 was purchased at Verizon during activation). I still have the no-longer functioning V710 in my possession.

We apologize for the delay. Verizon has advised us that details of the settlement
will be posted on www.VerizonWireless.com/V710Settlement by Monday, September 26, 2005. In addition, claim forms will be mailed out to Verizon customers on October 3rd and 4th.

I think the two biggest differences is that the e815 does not function in analog mode and that it is EV-DO compliant (faster downloads). The V710 is 1xRTT compliant only.

Thanks for the details. Please let us know when the suit gets settled. Any idea when that might be? Also, how long do you think the credit would be good for? (ie. how long after the settlement would you be able to return your phone...I may keep it for a bit and wait for a better option to trade up to)

Like any settlement this might take a while Verizon is being cheap about it all i mean come on only a $25 credit to your account and keep your phone and than the other 2 cheap options. Verizon is about to be in the dog pound again for something that I am SURE wont be settled so easily. They need to be taught a hard stern lesson and not get the easy way out and buy themselves out of these situations anymore its about time some people stand up to this company. You know what they say the bigger they are the harder they fall!

Thank you for your inquiry, and for your information.

We can advise that we have successfully entered into a very favorable settlement with Verizon. In short, they will be required to buy back any V710 (and V710 specific accessories) that the customer wants to return for full $ paid. The class notices will be mailed in early September. There are some other options as well, for those who want to keep the phone. Details will be set up on an administrators web site soon.

I did purchase my v710 prior to January 2005, but I dropped it in water about 2 months ago. Since then, I purchased an e815.

Any ideas on how that might affect my eligibility for the settlement?

The settlement would unwind whatever deal you made on the V710, but you probably need to have it in your possession.

If you didn't know all you needed to about OBEX and Bluetooth on the V710 by 2/2/05 and still bought one, then you have no reason to whine now about wanting a settlement.

How do the rebates that you received when you purchased the phone factor in the settlement. I only paid $150 after rebates I believe. Will they only give me $150 or will they give me the price before rebates and new every two credit?

I've had my 710 replaced twice now. I bought my original phone in Oct 2004. Am I still able to get in on this? Also is this going to be a nationwide deal or is it only for the states that the lawsuits were filed in?

Interesting, Verizon has a copy of your receipt. I just got a duplicate. Funny that the lawsuit requres a receipt if Verizon has it on file.
They don't show NE2 as a discount it just shows as the sale price. I was hoping to get the full $319 plus tax. It looks like if tax is included I'll get $254. $419 sale price $219 plus tax = $254
I would love to know more details about this. Will we have to start a new contract? Will I start over for NE2? I'm up for a new phone in June. I hope I don't loose that.

I walked into the Verizon store and told them I needed my original receipt They found the info was in their system even though it was purchased from another store. They printed a duplicate receipt dated when I bought the phone. That's it. 😁

Doesn't matter where you bought it, as long as it was purchased in connection with a Verizon service agreement.

So if I purchased my phone in June of '05 because of the bluetooth features i am unable to take advantage of the class action settlement even if i signed up at the website of the lawyers representing the case...this settlement should apply to anyone who got suckered into bying the phone with less than advertised capabilities...can anyone help me out with this?

At the time you bought the phone it wasnt advertised in a misleading fashion. We were told we could connect to a pc wirelessly. That claim wasnt made to you. Plus you probably paid $99 with a 2 year agreement, I paid $350 back on the first day it was released.
