They have all been sued and the courts have never ruled against the companies.
And here is the real kicker. They do not have to tell you you are getting a FRU.
And they can, and have even sold item(s) as new.
True that Circuit City and Best Buy sells returned merchandise as "open box" But they do also "replace" returned merchandise with open box items. This has been from my own experience and from my cousin who has worked for the corporate office of Circuit City.
My own experience last Christmas was I bought a HiDef TV. It didn't work. I went to return it when a new one was brought out it was obviously a "open box". I was told that as of February 2003 (confirmed by my cousin) if there is an "open box" item in stock the customer is to get that one.
Now that is the official corporate policy. That does not mean that a store manager or even a sales person has...
