Very upsetting situation.
She first told me I was ineligible to get a replacement phone because insurance was added to my account 10/15, which is later than when I got the phone. I explained to her that I had insurance on the phone long before that time, but I had upgraded my insurance from the normal 3.99 to the 4.99. What are these problems you talk about? As far as I know the phone was removed from shelves only cuz it rejected the 3G SIM card. I know for sure you guys don't have 3G SIMs. What problems are you experiencing?
The main problems are:
Clears log after power cycle
Asks to copy contacts from sim after power cycle.
Freezes frequently when closing aplications.
Other than that it has been a great phone. I'll suggest a Treo 650, but I'm really not a fan of treos. Maybe I could talk them out of the new iPAQ.
From my point of view, Cingular owes me a iPAQ because of their lack in quality customer service or a 650 with a $170 credit towards my bill. They decide.

I do think that Cingular is gonna have to get more involved in how XBM or Lockline handles the exchange program.
Giving out moto v180s for Treo 650s or Nokia 6682s or HTC 5600s is not a good look to John Doe customer, unless it is a temp until your phone is repaired.
Equal for Equal should be the thought or mantra of the program...dumbing down the customer experience is not the way to attract customers and adds to the perception (not necessarily the reality) of bad customer care.
Get off the script and add some flexibility to the program. Another missing thing from the ATT days...
But back to the original post....he should not have to deal with XBM or Lockline anyway as, based on the info he has provided in the thread, he should still be within his 30 day exchange period.
I work for Cingular WSC (warranty service, and handset repair). The phones were put on a backorder by Nokia, this is not an issue w/ cingular. We do offer substitute phones in your replacement, but if you would like a phone around or near price/features/reliability/reception. I would recommend the manufactor. This is their issue, and their warranty. They abide by their mistakes, and im sure would upgrade you to something better if not the same (if available).
cingular offers a warranty exchange to make the process simple and easy for anything in regards to your plan and services w/ having to deal w/ the manufactor. But in this situation, I would recommend them.
