Did you actually read that case? Kinkel is in a class action law suit against Cingular for fraud. The court said because it is a case involving fraud, it doesn't fall under the scope of the arbitration clause in the T&C. Also, because it is a class action case, it would be extremely one sided since Cingular doesn't sue it's customers in class action lawsuits.

That said, I fully agree with having an arbitration clause in a contract. It's part of the contract and both parties are or should be fully aware of it. If they have a disagreement with it, they should bring it up before entering into the contract. style doesnt equate to a good phone b.......my v802se is leagues ahead of the RAZR in terms of UI, and everything else that ISNT the actual size of the phone (Granted the phone isnt as large as people make it out to be but still)....i dislike the s710a because i like my screens to be covered
