roaming: get onto a nation plan and no roaming.

cancellation policy: yeah, not too great. but not a reason to not start service.. just a reason to check your phone signal in all the main places you'll go to within 15 days.

trial by jury: that's bullshit. (not as in you're lying, but as in I can't believe they would do that)

I can't think of another company that doesn't use arbitration instead of jury trial. There may be some, but I can't think of any.

If you don't like the 15 day cancellation policy, then get it from a store and get the full 30 days. Keep in mind, it may take a week for you to get your phone from amazon.com, and there's no telling what day they'll start the trial period on.

Yeah, but that plan explicity states you will be charged for roaming even though it is a national plan.

Is that just a mistake?

As for the trial by jury clause, Banks and other institutions use it as well.

The Constitution should easily trump such an obvious violation of rights. These sections are written to prevent the "common man" from seeking relief, not at all with protecting the rights of anyone.

that whole trial by jury thing is bs...several states have ruled against Cingular specifically and other wireless providers that that part of the contract isn't valid...its "unconscionable and unethical"

Kinkel vs Cingular Wireless is one such case...

Did you actually read that case? Kinkel is in a class action law suit against Cingular for fraud. The court said because it is a case involving fraud, it doesn't fall under the scope of the arbitration clause in the T&C. Also, because it is a class action case, it would be extremely one sided since Cingular doesn't sue it's customers in class action lawsuits.

That said, I fully agree with having an arbitration clause in a contract. It's part of the contract and both parties are or should be fully aware of it. If they have a disagreement with it, they should bring it up before entering into the contract. Unless the person signed the contract under duress, or the contract is breached by Cingular, the customer should have the right t...

And who said he didn't have WMDs? One reason why they haven't been found is they were exported, maybe to Syria, as some satalite photos show. Another is that the amount needed to kill millions of people could be stored in a briefcase. Bury that somewhere out in the desert under 20 feet of sand, and it could be a bit hard to find. We know he had WMDs because he used them on the Kurds a few years back. And you bring up soldiers being tortured by Americans?
