Interesting Dilemma...Need Help from VZW Employees
the weird thing is that voicemail was reset and I cant dial out, if in fact the phone was still active shouldnt i be able to call? I cant even dial 611.

It shouldn't matter if there is an active line on it. You should be able to reprogram the phone.
I called verizon and asked to activate the phone and they said they can not becuase the line is still avtice. so pelase explain further...

thats what I m thinking, but why wasnt it reported lost/stolen and why would it still be active??
and by the way i am getting my money back if i cant activate by monday

What has happened with your BB is this:
The phone number in the phone is current with some other person or company. I am thinking that the line has been suspended as to why you can't call or do anything with it.
With the ESN still attached to the number within the phone, there is no way to activate it on another number. The that number has to be reactivated with another ESN before you can activate it on your number.
Nothing you can really do until whoever has that number either disconnects the line and it frees the ESN (which it will probably reported stolen and can't be activated anyway).
Get your $$$ back.
