i just put in a claim on my samsung fascinate because it was lost. I will be getting this from asurion on thursday of this week. there are some questions that i have?
1. will this be new/unopened box with a brand new phone
2. if this is new can i sell this phone on ebay and then register a cheaper phone on my plan without repercussions

If you file an insurance claim for it, you would have to call Asurion and get it removed from the negative list. Not sure the procedures they have after claims but I don't imagine it will be easy to make that phone usable.

Your old phone is now legally property of Asurion Insurance. You are "required" to send it to them if you ever find it.
They will lock out the serial number with Verizon so it can never be used on a cell network again.
