Facts about Apple
Well I sorta know the answers, but I want to hear from the group and see how smart you are.
1. What was the first phone device that used touchscreen?
2. Who was the first computer company that used touchscreen?
3. Who was the first phone company that used a OS as a platform?
4. When was the first touchscreen phone sold?
5. When was the first touchscreen pda sold?
6. When was the first phone with icons sold?
The reason I ask, is that all of these were created before Jan 07 when Apple announced there IPHONE.
So how can apple sue over something that they didnt create?

Apple isn't suing HTC because their phones use a touch screen.
They aren't suing HTC because their phones are PDA's
They aren't suing HTC because they use icons.

Then can you tell me why Apple isnt suing, Microsoft, Nokia, Blackberry, Sony, HP, or any other phone company that uses the items that Apple is suing over? My point of my post is that Apple fans act like they created and own something that others have been doing for years. If I am wrong please provide proof.

1) Apple's actually suing Nokia over some of these.
2) The lawsuit specifies certain HTC-led initiatives with WinMo.
3) My guess is Palm, Motorola, and Samsung are next.
Apple's pretty clear with their lawsuit- the interaction HTC is using with the devices listed is modeled after what Apple pioneered with the iPhone (in contrast to say, a Palmpilot as seen with the HTC Mogul.)
Apple isn't suing HTC for using a touch screen, they're suing them for ripping off Apple's touch screen behaviors, which they patented. That's 100% legit.

Well in the past when Apple sued someone they havent really won. They always settle. All this is a PR stunt. Apple has a long history doing things like this. Plus this is a software issue and no one ever wins they just settle. This is just like the TIVO law suit. Microsoft, Directv and Motorola said they created Items in the DVR that Tivo used. Well Tivo was the first mass production DVR to have the these items in some form and the courts went with them. If it ever goes to court, it will end up with Apple loseing. There is no way a jury will say that Apple created and patened theses items. There patends are very open to opinions.

No, HTC will either have to stop using the said technologies and develop their own, or will strike a licensing agreement with Apple.
The burden is on Apple's end to prove it in court.
