Yeah, it's ex-Motorola employees that RIM is trying to hire. Normally I would be ok with it if it were due to the employee leaving for better x (benefits, pay, etc) but it sounds like these were employees that Motorola either fired or laid off. To me, that's extraordinarily shady on these economic times. Motorola is basically saying you're not worth their time and money, but at the same time they're also going to stop you from earning a living in your career during the holidays.

If Motorola fires someone, why cant they go to RIM? I understand if RIM was stealing employees but if Moto's the one saying see ya, I dont see what the big deal is. Am I missing something?

Sorry, just RTFA. Sounds like RIM is also communicating with current employees, as well. Though the article makes it sound like a lot of employees at Motorola are looking for other jobs since the company is making massive layoffs.

It usually depends on the situation. If moto laid people off, those people prolly got a severance package in exchange for not working for the competition for a certain amount of time. Personally, I think it's fair. But once your money runs out and those checks stop coming in, you should be able to get back to what you do for a living for a competitor.

It could be that they signed an agreement that after termination from the company, either quitting or being fired, they can't work for XXXX company for so long. I know some cell phone indirect companies do not let you work for another cell company, direct or indirect, within 15 miles of their location for 6 months

However, unless that employee is intending on bringing secrets from Motorola to RIM. Motorola can not bar any employee from performing a career oriented job if that is the only skill set they have.
It is a big game of im suing you, your gonna sue me, and we will settle when one of us starts to get sick of paying to make a point.
I especially don't think that if Motorola fires them the agreements should be valid any more.

I am simply astounded that anyone would consider a job at Motorola more stable than one with RIM - Motorola has a decades old reputation for hiring 1, 2, 3 thousand people over the course of time and then dumping 1, 2, 3 thousand people when their new technology fails.
I don't care HOW stable a portion of the industry is, I would not work for Motorola with their track-record of dumping employees.

If they sign a contract before being hired saying they wont wor for xxx company within x amount of time of termination, then they shouldn't be able to. If it's just, "ok you're fired and by the way, you can't work for rim" then it's jsut dumb and hope they get sued.
