AT&T Fined More than $10 Million in Florida

People click on "free Ringtones" Then enter their phone number and don't read the fine print which says they will be billed EVERY MONTH for access.

HOw can this lack of responsibility on the part of a consumer be ATT's fault. Perhaps ATT should not be billing at the whims of a third party. But come on people wake up.

READ THE AGREEMENTS.....NOTHING IS "FREE"

imagine that i access the web and subscribe you to a monthly ringer service for $9.99 do you think its your responsability??

but its just and ex. your right. but do you really always read full agreement??

Whenever I see the word "FREE" I not only LOOK for the fine print I READ it indeed.

Let's say I got to one of these sites and put YOUR phone number in. So then your resposible? No your not and so the State of Florida has to start somewhere with this thing, and AT&T can control this problem.

It's called false advertising. And that's illegal. The State of Florida is just protecting citizens.

why isn't the state going after the third party service providers? They are clearly the ones truly at fault for false advertising!! The free ringtones are not being provided by AT&T (oh my god I'm actually defending them? prepare for armageddon everyone!), but by the companies billing Big Blue.

AT&T (and others) should be suing the various 3rd party vultures for the fines that will be levied against them

Why do we as a society continue to reward consumer stupidity? This will only translate into higher wireless bills as the cost gets passed on to the consumer! 😡

Because its in big print free, but I agree its not only AT&T's fault, the ringtone providers are as at fault and should pay most of the burden. AT&T as an agent of the customer, should look out for that customer, more then the vendor.

But they aren't advertising WITH AT&T. They simply allow the customer to download content from whoever they choose. It's like buying a car and purchasing an extended warranty from another company that sells them. Would Honda be responsible for an extended warranty someone bought from another provider?

The Honda Dealership would be if it was bought there. The fact is, AT&T is doing the collecting and its showing up on their bill.

The fact is that AT&T has a contract with the 3rd party provider specifying the charges that will apply. When they charge the customer, it is because the 3rd party signed a contract with AT&T telling AT&T to do so. AT&T is merely providing a billing service under contract.

It is the 3rd party's responsibility to ensure that the customer is informed of any charges. AT&T does not and cannot control the 3rd party's advertising; in fact they are probably not even be aware that any advertising is taking place.

This lawsuit should be directed at the 3rd party vendors. Florida sueing AT&T is like them sueing your credit card company because you used it to purchase a fake Rolex thinking it was real.

It's just plain stupid. I hope AT&T ...

AT&T (and all of the other carriers, too) already spends a lot of time trying to police these vendors. They are looking out for the customer, but the shady vendors are getting pretty creative.

That's why it makes no sense for the state of Florida to go after AT&T. Short of not allowing any 3rd party access at all (which would cause screams of "monopoly!"), all of the carriers are already doing everything they can.

That's why this is just dumb. AT&T pays a pittance, some idiot politicians in the state of Florida get to brag about "standing up for their constituents"... and nothing changes.

Go after the 3rd party vendors who are making the false claims!

I agree, I work for a wireless provider and get the same kind of issues with customers coming in and complaining about the same crap. I just tell them to be on the safe side and buy applications from your own cell phone providers website. 🙂
