its more complicated with your cell phone. People sell this information and they also do mass spam based on phone numbers not just email.

not just that. your cell number MOST LIKELY was used before you got it. They recycle numbers, every carrier does.
Also, Parents want to disable their kids from texting, or getting texts. I remember reading a story about a girl that "wasn't all there" that had 5,000 dollars in overage fee's due to oversea companies sending her texts through "teen" magazines. And it's not like you can get a phone that doesn't do texting.

This law suit hardly has anything to do with people getting spammed; in fact, customer care normally will help out a customer on removing oneself from these lists.
I am one who does believe a lot of these messaging scams should be made illegal cause it does not require the account holder's permission to place charges on the account and many of them can be a challenge to be removed from.
