I asked for my unlock code from Cingular and they said they would give it to me once I am out of contract on the phone. So if you are out of contract or if you paid full retail for your phone, and its Cingular branded, they should give it to you.

That's correct. Since it's a w810 it's unlikely that it's out of contract unless it was a purchase at full retail though.

The OP will need to contact CS, who them submits a request to our teir 2 tech support, who then processes the request and will contact you in a few days with the unlock code if they approve it to be unlocked.

Yes, if you are a current Cingular customer call the international care department 800-355-4685 is there number I think, and tell them that you are going to Europe and you need the phone unlocked so you can get a prepaid sim card to avoid all the high roaming charges. I have done this a handful of time and it’s worked ever time.

It allows you to use a prepaid sim card from the country youre going to. Take for instance France, instead of paying 1.29 a minute in France, you could buy a prepaid sim with a French number that only charged you .20/min (not sure if that is an accurate price or not, never bought an international sim, just throwing out a number)

there are other ways of getting the phone unlocked if Cingular hassles you. Usually they charge, but they don't care why you want it done or how long you had the phone. We ususally go through a friend who has a programming machine. You might want to check with a store. Not a corp store though.

Per Cingular policy, there's several ways to qualify for unlock codes: One, you are out of contract; two, you bought the phone at full retail; or three, if you qualify for international roaming features (usually means you've had Cingular for at least three months, you've had good payment history, or your a high credit class) they will allow you to get the subsidy unlock code. All this may change in future though, since the rlibrary of congress passed new copyright laws, the government stated that cell companies must give customers the unlock codes if they request it, but that will more than likely be challenged in court.

When did that law say Cell Phone companies have to do anything different than what they already are doing?

Please check your sources because a lot of news agencies got this one wrong

What I read of that law said that it's now legal for customers to unlock their phone, not that companies had to help you do it or couldn't lock your phone to begin with.

I saw the same information on several different "reliable" news sources. While the articles dont state that cell companies must provide the unlock codes, it states (in different verbiage) that customers have the right to unlock them, which i would assume means if they request it carriers must produce them. Customers can already purchase them online or through third party vendors, so it would make no sense for that ruling to mean anything else other than either the carriers or manufacterers must produce the codes upon request. But then again, i'm almost certain that carriers will find a way to get around it, and its worded in a way that leaves open several loopholes....

What I keep hearing is not that carriers MUST provide unlock codes on demand, but that it is regarding a specific carrier that was suing it's customers for unlocking their phones. The ruling basically states that that carrier can't sue their customers anymore.

Customers may have a right to unlock a phone but the law states that it doesn't have to be done through the carrier.

"Cell phone owners will be allowed to break software locks"

This is the part that applies to cell phone owners.

"Billington noted that at least one company has filed lawsuits claiming that breaking the software locks violates copyright law"

And THIS is the part that applies to the cell phone companies. Not the first quote, but THIS quote.

Also, think of who he is. He's not a legislator but someone who is interpreting an 8 year old law. He's granting an EXEMPTION for cell phone owners. He does not have authority beyond that.
