No service- How to terminate contract?

My mom has cingular in Hammond, LA. Due to the Hurricane she has no service. In fact, VZW is one of the only companies working in this area. Is there a way to get out of contract if the service has been down for 2 weeks?

Try reading the T&C. It takes me forever to find one. Maybe contacting an attorny, or just paying the $200. Stuff like that is iffy. It was an act of God, but if they wait, Cingular will get towers going again. Maybe try calling Cingular and asking them about it.

If it's just one line, and you really want out, pay the ETF if they won't let you go, or read the T&C to see what it says. If it's a few lines, and you HAVE to get out, maybe check with an attorney, before you leave, do what he says.

It is 3 lines. I work at VZW. I have friends at Cingular who say the service may not be up completely for 1-3 months. The problem is (or what the employee told me is) that the switch the 985 and 504 area codes is under water and those customers are routed to another switch. That switch is now over crowded. Text messaging will rarely go through. Calls don't go through. My store has ported over close to 200 cingular numbers in the past week due to this. Any word on this would be great.

Again, check with the T&C, or post them somewhere where I can read them. I'm sure there's a clause in there for something like this. It may release you, or who knows. If it doesn't, and you think it may be a breach of contract on Cingular's part. Paying a lawyer may be less than paying ETFs or having damaged credit.

You have 2 options
1)you can put a hold on your contract and due to the reasons they will probably do that at no charge.

2)You can lie and tell them you are moving to Australia.

If either of these don't sound like your cup of tea you could probably go head 2 head with a Cingular supervisor and let them know why you have to cancel.

Either way I really don't think their human enough to waive the ETF. The T&Cs state somewhere that they are not responsible for "acts of God" or something to that effect, also they do not waive the ETF if you move out of country either. The way they think about it is if you knew that you were going to go out of country, why did you start a contract?

That's a lame thing, "why did you start a contract." People can't see 2 years into the future about where you're going to be. Either way. T&C may say things, but that doesn't mean they're inforcable. For instance, if you sign a paper not holding a mechanic liable for any theft or damage to your car, and when you come back, your stereo's ripped out of your car, and it's because the door was left unlocked? Guess what, you get a new stereo system. He was neglegent in leaving it unlocked.

Well, according to the FCC and CTIA all carriers had issues and all carriers are getting back to working.

So in short, no.

Actually for the hurricane victims you can get out without an etf. Saying you are moving to Australia may work sometimes but it is not a legal reason or any official way to get out without an etf. But for hurricane victims call us and we will see what we can do and we will do what we possible can to help you. Right now there is more leeway then normal.
