I don't work for AT&T, but I'd say if you got the subsidized price for the iPhone, they probably will not waive your contract breach fee unless you return the device.

If you paid the $600.00 or $700.00 price-tag for the phone, I don't think you'll run into any problems.

Under no circumstances will you not be charged an ETF. AT&T audits iphone accounts that are cancelled if the ETF is waived the representative that did it will be fired.

The company will charge you the $175 early termination fee plus has the right to collect the $200 phone subsidy. I have seen a few wise customers returning to our store with final bill on hand including the $175 plus prorated charges, then a month later with a confirmed final bill that includes any subsidy phone fees.

AT&T has a department that checks service cancellations along with phone returns. This is not an automated process so it might take up to 6 months for them to catch up, but usually is done within 30 days from final bill.

Definitely no additional fee other than Activation first months of service the ETF and then of course what you already paid for the phone.

The only problem you may run into is if you ever try to purchase another iPhone. ATT is tracking these accounts, and tracking the customer's who cancel and do not return the devices (whether by choice, of claiming they were lost/stolen). These accounts are being tagged in the system, and more and more stores are refusing (with corporates blessing) to sell these customer's more iPhones.
