Help! Best Buy warranty?

Okay, is this illegal or what?
In late November I bought the 7400 just to replace my messed up VGA1000. The only reason why I got the warranty was the fact that there is the option of upgrading your phone. Now I have decided I want the 5600 and called 1-888-BestBuy hotline. The lady told me that Best Buy USE to offer the upgrade option but NOT ANYMORE. I was never notified of this. So, is this illegal of what Best Buy has done?

ps. My business law teacher has told me to go to the store and talk to the District Manager and tell them, "If I can't get an upgrade, I'm going to file a small claims report to the Better Bussiness Beareu." -Do you think this would work too?

Most waranties from retailers (I used to work for CompUSA) have a clause in them that says they can modify the contract with or without notice. Sorry bud, you're probably SOL.

P.S. CompUSA's replacement plans will give you

  1. if the item is still instock: the same item for whatever current retail is
  2. if it is out of stock and still current, the current retail value towards another item
  3. if it is discontinued and out of stock, whatever your receipt shows you paid as credit towards a new item.

  4. That's how I always kepp my $400 video cards and upgrade them through time!

just finished reading my warranty brochure and there is nothing that on it that states that bestbuy has the right to modify it without notice

what they sold you was a warentee not an upgrade program. they actuall warentee staes tha tif your product is defective they will replace it (this is a very brief summery) from what you stated is sounded more like "i am tired of my old phone and i really want the new sanyo 5600" so you called the bb # and they said no.

you asked if it was illeagal. the answer is yes. it is illeagal. what you are trying to do is fraud. now about the better business beareu if you go in and mention them they will laugh you out the door. the only way you could possably win if you filled a law suit which would be absolutely stupid because because you would spend more on the lawyer then you would on the new phone and bestbuy would definately win the law suit an...

by the way the best buy warentee is worthless and honestly my self i would never do it.

however what i would do is get my phone from costco. they have a life time warentee on every thing. and they replace in store. which means if your phone is not avalible you get an upgrade 😉
