lockline fraud and ebay

has anyone run into any problems buyin a phone on ebay that has been reported to sprint as "lost or stolen," made a lockline claim, sold the "lost" phone on ebay? is there anyway the seller of the phone can be held liable for selling this phone? thanks for the help.

I'm not fully sure I follow you. Did you buy a lost or stolen phone on Ebay, or are you trying to sell a lost or stolen phone on Ebay? If you purchased one, then file a complaint with Ebay, Paypal, and have Sprint look into where the lost or stolen phone came from.
If you are thinking of selling a stolen phone, then don't do it. You can get into major trouble for doing that.

If you purchased a stolen phone, then give all of the sellers info to Sprint so they can go after this person. And call up lockline and tell them what happen. They can track the phone and punish the seller.

Sprint will not "go after" anybody. You have any idea how many manpower it would take for Sprint to seek down a person selling a lost/stolen phone? Take into consideration the person who sold the phone received it from someone else for..$20 and didn't realize it was lost/stolen at the time.

The person possibly might not have known of it's status. I'd start with a polite message to the seller, asking them for a refund. If they refuse...THEN go to ebay and paypal.

No, they will not persue that for you. It is in the agreement that we are not responsable for your aquisition of a stolen phone if purchased from other sources.

well paypal said they couldnt do anything so looks like im stuck with a phone that cannot be activated. thanks for the help

Now you know the risks in buying Sprint/Verizon/US Cellular/Alltel phones on eBay. I always tell my customers about it when they mention buying a phone from eBay.

....hmmmm, and the problem with PayPal and their dispute resolution...

I bought a phone years and years ago to use on ATT... The a$$#ole never shipped it, it took PayPal thirty days of investigating to determine I was gypped and there was nothing I could do. Called my bank, got the money back, and I'm no longer allowed to use PayPal because I went over their heads.

You have the seller's information correct?

Perhaps you should consider contacting the local law enforcement in the seller's area.

You should have adequate proof to clearly demonstrate that you were sold stolen properly knowingly by the culprits.

You may not get to use the phone, but you will have the satisfaction of knowing that you have done what you could to punish the culprit, as well as, prevent further people from encountering the same situation.

The best thing to do when buying a phone on ebay is after you have won a bid, ask for the ESN before payment. Then check the ESN with Sprint to make sure it's clear. Once it has been cleared, pay the seller. That's really all you can do to protect yourself. If they provide a false ESN or it does not match the model of phone it is supposed to be then there is no deal.
