Actually, if you read the article at the main site it's technically theft because the person who found the device had knowledge of who the owner was and how to contact him.

It also says he tried for a flippin' week contacting Apple and got shut down because they didn't tell any of their employees what's going on.
It wasn't for lack of trying on his behalf to get the phone back.

And it's not like he couldn't have facebooked the guy. "Hey, I found your phone in a bar" on his wall. The guy didn't try too hard obviously.

The article says the Engineer left the phone at the bar on his birthday. I mean, he left it... so technically he lost it. It's not like someone fought him off or used a weapon against him to steal the phone.
On the other side, I guess this leaked ruined apple's conference for june lol

He saw the guy had Facebook on his phone, but said blatantly he didn't "dig" for info, and a matter of a few hours later it was remotely wiped. Giz did the digging on the engineer.
The only sure fire guarantee of getting it to who owns it when he knows it's a prototype is by contacting Apple. Which he did.

Before you ask, yes the new version (not yet released for another 5 months) of the iphone with a working OS and extremely upgraded hardware will sell for more than the car you drive.
