I think you are probably missing the point here. The point is that a company is accusing VZW for a policy that has been discontinued through current ad campaigns. Because of this false information, it can (and probably did) affect VZW's customer base and growth, which has financial ramifications and damages.

Imagine if any company makes false statements about a competitor's policy through PR or marketing? Pretty messed up eh?

But you have to prove that Alltel continued to sell the ad after vzw proved they were allowing customers to change.

To me the PR move [of a lawsuit] to get it out there that they allow customers to change is worth more than the the time of a lawsuit and any damages they get paid.

Besides....

US Cellular isn't mentioned in the ad. It's T-Mobile, Sprint, Verizon and AT&T.

That's why they are in pink, yellow, red and orange shirts.

You think thats bad? The local centennial office told one of our new customers US Cellular does not work out of state. I had to let the customer know we have a true national plan, unlike centennial that has a national plan which roaming all over the place. Whoever told the customer we didnt work out of state sh9uld quit trying to sell out service. Centennial's a joke...

Anyways, when did people start bashing their comptition on national TV? I thought there we laws against using their names and logos, ect, expecially when your bashing them. I think a Pizzahut ad was doing the same thing, in terms to Papa Johns and Dominos.

It's not illegal if the allegations you create on the commercial are true and factual:

"Alltel offers to charge for roaming. Sprint doesn't. Get out of the stone age, Alltel."

That's legal.

Here's what's illegal:

"Alltel has stupid phones, and Chad is dumb. They charge for turning the phone on. Sprint doesn't."

That's illegal, because it's unfactual and slanderous.
