Prepaid Under Patent Attack

On Friday, a Boston jury awarded $128 million in damages to Freedom Wireless Inc. in a patent lawsuit involving technology and systems to provide prepaid wireless service. The primary defendant was bcgi (Boston Communications Group Inc.), a major provider of account and billing systems for wireless carriers. The lawsuit also targeted bcgi's carrier customers, including Verizon Wireless, Cingular Wireless, AT&T Wireless, CMT Partners, and Western Wireless, although Verizon was removed as a defendant as a result of a settlement for an undisclosed amount. Following the verdict, Freedom Wireless filed additional lawsuits against Nextel and Alltel. Next month, a judge will rule on additional post-trial motions as well as a separate, non-jury trial regarding unenforceability of the patents. The outcome of those rulings could triple the damages. Appeals are expected.
