getting frustrated
bty my wife has had 2 replacements both for faulty phones
1) all phones have a factory warranty of 12 months covered by manufacturer (not sprint)
2) you have 30 days to sign up for total equipment insurance and if you don't (it's always offered at stores) then you are accepting liability of cost to replace the phone after the 1st 12 months for defects and for accidents you gotta cover it, sorry about that (you could hate sprint all you want but this really is an industry practice)
3) upgrade w/ at least a $150 (mail in rebate and addt'l discounts can be added SOMETIMES) on 22 month of Service Agreement in exchange for continued service

If you have insurance you can get it replaced for the same model as many times as it takes. That is what insurance is for.

Actually in the insurance agreement under section 3 titled "Limits of Liability" - Section B states:
B. AGGREGATE LIMITS.
A maximum of three (3) replacements or repairs of Covered Property will be allowed per Insured
Subscriber in any one twelve (12) month period. The twelve month period is calculated based on
the Date of Replacement for each covered Loss.

But, to help you out, maybe you can call cust. service and let them know all the trouble you are having. And maybe if you do your UPGRADE over the phone with them with a new 2 YR AGREEMENT, they will waive the mail in rebate for you.

The secret number is "4". "Know the "lemon rule" as it applies to your phone warranty. If you have 4 replacement phones in a 1-year period, Alltel's policy is to switch you to a similar phone. You just have to ask, and the magic number is 4. We can't, and won't, do it before then."

Now, granted you are correct that the store manager can authorize a different model, but that means he will be hit on his next audit and will need to explain exactly why he did the out of policy exchange, and telling your DM that you did this for a customer that is eligible for the full upgrade discount is going to get that store manager in trouble.
What you have to remember is that TEP is like an extended warranty and insurance on your car, it is there to help you fix your current phone, it is NOT a like a lease program on a car that you can trade in your old model to get a new one.
