have you contacted samsung? unfortunately w/sprint it takes a while for the average agent to figure out what to do when this happens... the rule is this

1) all phones have a factory warranty of 12 months covered by manufacturer (not sprint)

2) you have 30 days to sign up for total equipment insurance and if you don't (it's always offered at stores) then you are accepting liability of cost to replace the phone after the 1st 12 months for defects and for accidents you gotta cover it, sorry about that (you could hate sprint all you want but this really is an industry practice)

3) upgrade w/ at least a $150 (mail in rebate and addt'l discounts can be added SOMETIMES) on 22 month of Service Agreement in exchange for continued service

complain threaten all you want. Sprint is really cracking down on this. If your under contract you will probalbly get NOTHING.

If you have insurance you can get it replaced for the same model as many times as it takes. That is what insurance is for.

Actually in the insurance agreement under section 3 titled "Limits of Liability" - Section B states:

B. AGGREGATE LIMITS.
A maximum of three (3) replacements or repairs of Covered Property will be allowed per Insured
Subscriber in any one twelve (12) month period. The twelve month period is calculated based on
the Date of Replacement for each covered Loss.

More to the point for Chris, I refer you to this post I previously made - it should still be relevant.

You have a $150 upgrade, go into a store/online and pick out a phone. I'm aware that you won't get a free phone. Honestly though, you can't honestly think you deserve a free phone just because you had some issues with your phones. I've worked at a sprint repair center. It doesn't matter how many times you come into my store with a broken phone, but I wouldn't upgrade you to a different model. You can't buy a Honda Civic, and take it back to a dealer a year later and get a Lexus can you?

But, to help you out, maybe you can call cust. service and let them know all the trouble you are having. And maybe if you do your UPGRADE over the phone with them with a new 2 YR AGREEMENT, they will waive the mail in rebate for you.

BUT if you ...

This may also be relevant to your situation. It pertains specifically to Alltel, however Sprint most likely has a similar policy.

The secret number is "4". "Know the "lemon rule" as it applies to your phone warranty. If you have 4 replacement phones in a 1-year period, Alltel's policy is to switch you to a similar phone. You just have to ask, and the magic number is 4. We can't, and won't, do it before then."

You should be able to trade it for a different handset threw the Service and Repair Center. (If you get someone to do their Job properly) If you have 3 phones all device issue (not user) they should trade for something comparable in price and features. If that doesn't work I do know Assurian will trade you for a different handset, but they will require the deposit and you only get three claims a year so if you have done one already I wouldn't suggest it. Care should be able to see your problems and help you out, but they may be hesitant since the repair center hasn't. My advice is to go into a service center (next time you have a problem) ask for the service manager, be polite and plead your case. He can trade you out for a new phone of a di...

I work in retention and yes issue resolved is a big deal. However, so is staying in business and it does not make business sense to give a customer a NEW device when the service and repair system is in place to repair phones.

I personally have worked in a Service and Repair Center and it is NOT policy to give a customer a different model on a service and repair exchange.

Now, granted you are correct that the store manager can authorize a different model, but that means he will be hit on his next audit and will need to explain exactly why he did the out of policy exchange, and telling your DM that you did this for a customer that is eligible for the full upgrade discount is going to get that store manager in trouble.

What you have to remember is that TEP is like an extended warranty and insurance on your car, it is there to help you fix your current phone, it is NOT a like a lease program on a car that you can trade in your old model to get a new one.
