Just about every new product in consumer electronics is going to have a problem or two, and there may also be technical issues too. In this potential court case, Apple's problem is one, Jose Trujillo, who is suing Apple and seeking class-action status in a lawsuit over the iPhone. It turns out Apple "marketed it's [sic] iPhone as a 'revolutionary new mobile phone' that incorporates 'high technology'," whatever that means. Besides that, most of the substantive allegations focus on the iPhone battery, including:

* Unknown to the Plaintiff, and undisclosed to the public, prior to purchase, the iPhone is a sealed unit with it's [sic] battery soldered on the inside of the device so that it cannot be changed by the owner.

Hey did you ever read the court case where a guy who was robbing a store, fell through the stores skylight while trying to rob the store and injured himself.

Well he sued the store and won! Of coarse this case was in California. Then there's the woman who sued McDonalds because she didn't know her coffee would be hot and put the cup between her legs, the cover came off and she burned her, well she got burned, she sued, she wons millions.

Then you have the guy suing his dry cleaners for loosing his pants and wants fifty three million for the pants....at least that one didn't get anywhere, but guess what, he's appealing and what's worse, the guys a judge himself!

So with the lawsuit you have describe, never say never about not winning...

I agree, but it's just sad what this country has come to. Looking for anything to sue someone for. SAD. I am not a huge iphone fan but come on, they knew about the batt. before it even came out.

I was hoping that what they do in England they would institute here, and that is, yep you can sue, but if you loose the case, you pay for all the expenses of the person you sued. Believe me people in England only sue over really bad stuff. It will never happen here because most of the politicians are lawyers and would never let that happen.
