yes, its perfectly legal. at&t has far too much on the line that would go bad for them if they went and did something illeagle. all of the plans that at&t offers are more or less the same price that cellular one offered, the only difference is that at&t does not offer the unlimited plans. the reason you cant buy an at&t phone and place your sim in it is because at&t has made it a practice long ago that they lock their phones so they can only be used on their network.. i think you were mis-informed to some degree, probably by a cellular one employee over the phone and thus the employee was also mis-informed as well.
