It's reasons like this that reinforce per Yahoo news that AT&T is one of the top 3 hated companies in America. This is not limited to Telecom IT'S THE TOP 3 MOST HATED of all companies period.

Although At&t has an iron clad protection against class actions lawsuits built into their terms and conditions. One man successfully SUED BIG BLUE and won an $850 claim. (big blue is currently appealing this) ... All because of at&t throttleing practices on their estimated 17 million "unlimited data" subscribers .

But based on that precedent if the perfect storm were to hit AT&T where all 17 million subscribers followed suit that would be approximately $14.5 BILLION. That would send a huge messgae to big blue and if there was a mass exodus as a...

Wow you "went there", actually 12 jurors found him "not guilty".

In that case it aS OJ's checkbook vs. The ill-equipped States Attorney.

In this case one singular man equipped with his own finances and his only weapon against big blues lawyers and their bank account was the exhibit of their unfair throttle practice on at&t customers who in good faith kept, maintained and loyally paid their invoices monthly for no other reason then those mere 17 million customers aren't as profitable as those with newer finite plans that may be charged overage

Sorry should have kinda stated what I meant by that. I mean, I applude the guy who went up against big blue and won with the data throttling, good for him.

My statement was to argue that just because a court says something is wrong or right doesn't mean that it is.

Do not expect the ATT judgement to stand.
It was a small claims court action.
If the defendant does not appear, the plaintiff is awarded, no matter what the merits of the suit if the Judge allows it to go forward.

The wording of the contract will get it dismissed on appeal most likely.

Also not stating the AT&T is the best company or that the policies are the best when it comes to throttling, but there has to be at some point some kind of throttling. AT&T offers unlimited data, but at what point is too much. The more you use the more you cost the company, and eventually slow down the network for other customers. Some people state that there is no such this as an exaflood, but you have a admit that the data speeds do slow based on how many people are connected to a given network.
EX. Dsl or Cable internet runs slower when more people are on it for a given line.

So at some point data has to be throttled whether it is the entirety of the data itself or a certain type of data (ex. My DSL provider slows torrent downloads)
