AT&T had anything resembling a functioning network where I live. Yet their service is still ridiculously bad after their prior month of throttling.

That said, 3GB is still low. I've used between 4-5 GB/mo ever since I got my iPhone. When I signed this contract, there was nothing wrong with 4-5GB, now there is.

Your contract for services does not guarantee speed on the network.
If you are an unlimited customer, you have had that for probably over 2 years.

If you are talking about the contract related to the phone, that is a different animal and has nothing to do with voice or data service.

I'm confused if the network sucks where you live then how the hell are you going through 4.5-5 GB a month, the only way you're going through that much is if you're tethering or streaming video or audio all day, if you can tether and or stream audio or video all day and use it to go through 4.5 to 5 GB then the network in your area clearly does not suck, if it did there's no way you could go through that much data cause it would be to slow to be usable, i.e. Boost and Virgin have unlimited data on smartphones, but it's unlimited cause the networks are painfully slow, they know they can offer unlimited cause it sounds awesome but it's slow so you can barely stream things and hence forth not use very much data, Virgin will even throttle after 2...

I use anywhere from 1GB-4GB/month and I don't use any video/audio streaming services (I might view one or two YouTube video every few months). I also don't use my phone as a modem... and I have a Blackberry , which is very efficient on data. So, it is possible to still use a lot of data through other applications...

I have service when I travel or make client rounds- even then it's hit or miss. I have to be on WiFi at home, even though I have 5 solid bars of service and live on the top floor. Their network is crammed until about 2AM-8AM.

Why don't I use Boost Mobile? Because the iPhone doesn't run on Boost Mobile.

wrong, I just understand the contractual obligations of the client services involved here

Wow this comment is so flawed.
The contract related to the phone?
It requires a data plan. Nothing to do with? Call AT&T and try to start or have service with an iPhone and not have a contract that includes data.

You obviously have very little knowledge or are confused.
Your voice and data services are contractural but there are zero penalties for cancelling them.
For most carriers, you are billed in advance for voice/data services, which ensures that you won't skip without paying the final bill.

If you have penalties involved, it is because you agreed to one to get a new phone at a reduced price which will involve a two year contract to remain with your carrier, usually with decreasing balance penalty over the 2 year period.

If you haven't done that, there is zero penalty for cancellation of service.
If you open a line of service with your own equipment, you will have no contract with most carriers.

If you have cellular service and don't...

No that is so wrong. You must have a data plan to have a smart phone with AT&T. To cancel the data plan you have to get a basic phone or cancel your service.
If you have the iPhone you must have a data plan. If you have the so-called unlimited plan you are limited and throttled where a person with a limited plan is charged more over 3 GB but not throttled. I am not confused the data plan is required and this is a money grab intended to push more to the tiered plans,

You're right, it does not guarantee the speed of the network, however there's a difference between AT&T being unable to deliver speeds due to technical restrictions, and them deliberately slowing my speed down.

Let me be absolutely clear on that... there's a difference between AT&T being unable to deliver speeds due to technical restrictions, and them deliberately slowing my speed down.

Yes there is, but it's not contractual.

Since they did not guarantee any speed, any expectations of speed were manufactured by yourself.

If you can't find a clause that mentions a guarantee of highest possible speed at all times, then it ain't there and they can slow their network, or individuals at their whim.

"When I signed this contract, there was nothing wrong with 4-5GB, now there is."
~~~~~~~~~~~~~~~~~~
When you signed your contract most users were not using as much data as they are *today*, but with data usage increasing 2000% in metro NYC and SF areas and some users watching the entire Netflix catalog while on mobile networks...something had to give.
The real question is....where does your access to unlimited *FAST* data begin and where does it end? The answer is that it begins with the first day of your usage cycle and it ends when it starts interfering with *ANYONE* elses access to the same network. I can maintain using under 200 Mb per month using WIFI, so why can't others?
Maybe others arent glued next to wifi all day like you are? To someone that uses 100 Mb a month, you are a data hog. Maybe they should lower the throttle threshold to 100 Mb? Or......INVEST IN THEIR FREAKIN NETWORK!!!!!!!!
Tether, so far I haven't seen you post anything productive. You keep saying "Invest in your network", like AT&T really isn't investing capital in their network...even after you learned by SEVERAL posts in another post that AT&T invests more capital than any other network. You asked for an article, when you got one, you disregarded it like it never exsisted. You're so closed minded to the facts and that makes your posts unreliable and just a rant.
Your response to anyone that would defend or write anything positive on AT&T's behalf is that they are "just an AT&T fanboy"...we could say the same about you with VZW.
I'm glad you are happy with VZW, you should keep them. I've had TMO, VZW and currently AT&T - I can honestly tell you, AT&T h...
Eskeebel, talking to Tether is like talking to a child. He/she says the same thing over and over again. Its ok to be a verizon fanboy, but its not ok to be an at&t fanboy. Where were all the verizon fanboys when their network went down last month...or the month before that? They were probably going through the withdrawl shakes.
I am a Verizon Wireless customer for a couple of reasons. NOT because I hate AT&T or love Verizon. Verizon invests more in it's network and AT&T has to play catchup. AT&T spends more on it's investors. The things AT&T claims to be the greatest are things they fell behind on. Talk and web at the same time? Because they did not upgrade their networks and had to add a separate data network to avoid replacing older voice GSM tech that did not get as fast as their WCDMA data network. The Great AT&T is a great spin doctor. Also AT&T had to push it's LTE into service faster to compete with Verizon.
Last thing Verizon fans where raising hell when the data outages happened.
Of course data usage is increasing. Water is wet, the sky is blue. Did AT&T seriously not think people were going to use more data?
And I use WiFi for most things (especially data-intensive things) , but simply because you're glued to WiFi all day doesn't mean I am. Also, paying $30.00/month to use 200MB is a complete waste.
Hotel WiFi is notoriously bad, airport WiFi is a ripoff, and even cafe WiFi is spotty.
"Also, paying $30.00/month to use 200MB is a complete waste. "
~~~~~~~~~~~~~~~~~~~

That's why 200MB is $20 per month on AT&T, not $30. For $30, you get 3,000MB per month!

Wifi networks are only as good as the hotel's, cafe's, or airports internet connections.

Okay, so say you're on the 200MB plan. Paying $20.00/month for 200MB is a screw job and a complete waste of money.

To put that in perspective, I pay $20.00/month for a no-contract 3G hotspot connection on Verizon Wireless for 2GB of data. And that's on Verizon Wireless, and that's on a much-more-data-intensive hotspot.

So I'll frame it like this- these plans are a money grab by AT&T.

You might do some price research first before responding.

There was a 200mb plan, now grandfathered, but it cost $15 not $20.
The new lowest plan is 300mb for $20
