Do I smell a lawsuit?

I called Motorola to ask them what they were going to do about the Bluetooth promotion since Radio Shack is selling the V710 almost two weeks ahead of Verizon Wireless. That, of course, gives the Radio Shack buyers a distinct advantage and the likelihood is that given a 2 week lead time and a national network of stores, the first 710 people will be Radio Shack purchasers.
Motorola sent me the following reply:

Regarding your concern, the BlueTooth Headset Promotion will start today because not only Local Radio Shack stores are currently selling the Motorola V710. For customers who would like to purchase this phone through Verizon Wireless directly, please note that the phone is already being sold through the Verizon website. Theref...

I bought the phone last week from RS. I am unable to register at this time. They told me i had to wait till this week but did not give a specific day. there is no advantage

A lawsuit over a free offer? I doubt it. The whole thing is just a promotion to sell more phones. We'll be lucky if the whole thing isn't cancelled because RS released the phones early, as I understand it, "without Verizon Wireless authorization." Read the fine print... 😳

I am not saying that I would file a lawsuit, but someone might, especially with deep pockets like Moto's. Even though it's a free offer, they have to give everyone equal footing. So while RS purchasers may have to wait until this week to register, they still have a one week head start on those of us waiting to buy the phone at VZW. As far as their fine print: ANY OTHER CAUSES beyond the control of Motorola, which corrupt or affect the administration, security, FAIRNESS, INTEGRITY or proper conduct of this promotion, Motorola reserves the right at its sole discretion to CANCEL, TERMINATE, modify or suspend the Promotion." This certainly is within their control. They should (and could) hold off registration for the promotion until Verizon...

not to mention the fact that IF there was a law suit, it would end up being a class action type and only the lawyers make anything on a class action! 😈

Spill some coffee and go sue McDonald's. Jesus. It's a free offer. It baffles me that people can be so 1) dumb 2) greedy that they would want a lawsuit over a free item.

I know you weren't saying you would, but I could see someone doing it as well.

It's not fair this. It's not fair that. Shezzzz. What about me. It's not fair that I am under a NE2 contract and I have to wait until Sept before I can get a new phone (a v710 or anything).

Should I be able to sue?

And I don't know why you are so upset. The phone's bluetooth headset doesn't even work. It requires a software update and who know when that will be out.

I don't smell a lawsuit... but I do smell that answer being trash. We do not have this phone on our website, and our intracompany website clearly reflects the 11th as the release date. It is not even available to employees until that date.

The promotion is up to the discretion of the company offering it. They can change the rules at any time or cancel the promotion at any time. LOL U MUST BE DUMB.. its 70 bux for a headset anyways, stop being so cheap.
