I no longer want the Lemon Bionic, what are my options

I got this phone on the first day it came out, so its too late to just take it back. However, I think it is a lemon, I don't want to wait for a November fix that might come and that might work, and I am paying for services that are not functioning (i.e. data).

Do I have any option for getting rid of this awful phone?

If I break my contract and pay the $350, could I get a new contract? That might be cheaper than paying full price for the new phone.

Shame on Verizon and Motorola for putting out and selling this phone, and for advertising 4G data that does not work on this phone.

Cancel.
Pay ETF.
Wait one week.
Call VZW "Win Back Team".
Start all over.
It is possible they waive/refund the ETF you paid.

**disclaimer....just guessing!!

Years ago, my store was the same except I didn't cancel..I ported to ATT. Epic fail...called Win Back, and all was good.
