Refurbished iPhone 3G in California

Not a sales ad, but a complaint. Why does a 49 dollar refurbished 8Gig 3G iPhone have 43 dollars in taxes? When a new 8Gig 3G 99 dollar iPhone has 10 dollars in taxes?
Someone explain to me why CA luxury tax is so screwed up?

The California state government, in order to enhance their revenue stream, has decided to apply sales tax for any cell phone transaction on the full retail price - before any discount.
If you got away with only $10 on the 8GB 3G, somebody did not do the tax right as full retail is $499.

It's always fun to charge $40 or so in taxes on free phones.
