I bought my EnV touch out right (no upgrade) on Nov. 6th, and was not informed at all about the required data plan, I activated it on my account on the 8th, and once again was not informed about a data plan. I choose the device because I checked at a retail store, a corp store, on-line, on-line cs chat, and even called into CS to find out if the phone needed a data plan. At all times I was informed it does not. About 4 days after I started using the device the battery took a dive, so I went into my local corp store, and the rep helped, and I was very happy with the rep. I believe November 8th was the day it started being required. I doubt there is anything you can do. I would think you could return the phone and get your money back though and choose a different device.

Adding to my last post. You should still be within the return period and they can't keep you from buying a device at retail and not using your upgrade. There shouldn't be an issue.

If you got the device from VZW you can still return it for a full refund. There is no way around the data plan, it is coded into the system.
Your only option is to return it if you dont want to use the phone for email or browsing. If you arent going to use it for email or browsing anyways, I would suggest getting a lower cost phone anyways.

Here is the mistake that you made, not activating it when you bought it. The data plan requirement went into effect for all ENV Touch phones activtated starting on 11-8-09. Sorry about your luck but we all have to be responsible for our own actions.

The LG enV Touch required data as of November 8th. I did not require data on November 6th. Had you activated the day you bought it you would have been fine.

After all the research i did, why would I be in a rush to activate? I was never told that it was a possibility to have to add a data plan. I waited a couple days to see if my wife wanted to use the phone or not. Once again, why should it matter how long I waited? The system shows the warranty date as the day I bought, which is before the 8th.

I've been using the Verizon computer system for over six years now.
When a Verizon computer sells a full retail phone, that phone is activated in the network. We can't sell a phone like we sell a headset or car charger - the system won't allow it. We literally go through the upgrade process in the system, regardless of price. You could be paying full retail, or you could be paying the one year price, or you could be paying the two year price - the system makes us process the phone, have you pay for it, then activate it. This tags the ESN in the system with an activation date. Back a few years ago, around 2000, I bought a brand new LG VX10 flip phone as a back up phone. When I bought it they promised me that I would not have any problems activating it and I could use it any ttime I want!
Well, threedayas ago I broke my Qualcom 1960 phone and went to put the vx10 on it.
They blocked me from activating it and said it couldnt be used because it didnt have GPS in it.
When I bought the phone the rep NEVER mentioned ANYTHING about GPS!
I went to my local store to return the phone since I was obviously lied to when the salesman sold it to me (they were just trying to make a sale by lying to me!)
