Some things are simply too generic to be copyrighted.....
The idea that because Apple (might have, who knows for sure?) made the first slate phone that therefore no one else can do so is mostly politely described as 'asinine'.

Samsung's phones bear a wee bit more in common with the iPhone than merely being a slate, but regardless how 'obvious' the design is now, nobody else figured it out.
