The open access rule only applied to the upper 700 C block. So for any areas that Verizon acquired the upper 700 C block, they have to have open access. Verizon acquired all 6 blocks on the mainland, and a 7th block for Hawaii. So they have to have open access in 49 states. They didn't acquire any licens...

"Open Network" refers to much more than just allowing compatible phones on the network. Imagine that you have this great idea for an in-car device that will talk to other cars. If you create the device to run on a CDMA Network, VZW will allow you to run it on their network and use their spectrum, possible even "re-selling" the airtime/capacity etc required for the device. All of course subject to close scrutiny with regards to interference on the network.
