im really not going to get into this arguement/discussion for the simple fact your not signing a contract for service, your signing a contract that states you will be making monthly installment payments for the phone. like the article states your technically on a month to month plan because your not on the traditional 2 year service contract

The whole point is that it turns out that this is, in fact, a contract for service because if you drop the service it changes the terms of the financing for the device. The device financing contract is directly contingent upon keeping your service. You cannot have a contract which is contingent on continuing a service and somehow claim that it is NOT a service contract.

You can say, " your not signing a contract for service" until you turn blue in the face, and that statement will still be false. That's what the people filing this lawsuit believe and I agree with them.
