If Apple patented the wheel, then the competition would be forced to invent magnetic-levitation hovercraft.

So we'd all have flying cars.

Please don't give Apple any ideas. The common design patent they have is BS as well as the more recent patent they filed. Oh well it is what it is. This is like a race car driver throwing out oil or nails behind his car to slow down the competition. Don't worry though, the bad guy loses in the end.

I don't know about that. Most of the Patent Judges seem to be lacking common sense and will probably award Apple the win because he can't understand the term obvious as it applies to patents. (one of the rules before a patent is awarded is if it is "obvious" then it is not patentable)

Judges have to issue rulings according to what the law says.....they can't 'exercise common sense' they have to apply the law as it stands......the problem isn't judges, the problem is the law.

Actually the problem is the lawyers. The thing about the law is that it has to be interpreted. So a good lawyer can argue that a law does or does not apply under certain circumstances.

How is this 'common' ? The slide to unlock (remember when Samsung did 'tap to unlock'? That was their solution before finally just up-and-copying it.)

The universal search? Did any Samsung phone have it before the iPhone? No?

Then how can you call it obvious?

To extend your race car analogy, it's like a competing driver latching onto the car in the lead with a rope to try and gain speed on him.

um what about all the idea's that apple stole from palm and there touch phones then blue can you defend that hell gates even admited he stole stuff

Well....the bigger issue is all the stuff Apple stole from Xerox Parc project to make the Mac....and the amount of stuff 'borrowed' was so big that when Xerox threatened to sue, Apple settled immediately by giving Xerox millions of dollars in stock options to Xerox....which is not exactly a sign that they believed themselves innocent of the charge....
