NEXT MAJOR VZW LAW SUIT???

Get this... 1 1/2 weeks ago I purchased the Razr. On my line I previously used a V60c. Unhappy with the Razr's terrible battery life, I planned to return it within the 15 "worry free" period - expecting that my account would be reverted to its original state. However, when attempting the return VZ hit me with a big surprise that I was NOT happy with. Apparently the FCC's regulation regarding E911 compliant phones went into effect and VZ was no longer able to pair my v60c with my line. After arguing in store, politely arguing with customer support, etc... no success. Customer Support offered the possibility that the store would swap out my V60c with that of a refurbished Mot 276, which I agreed to, however when discussing with a store manager...

Just keep calling and complaining 'till you get a positive answer..... In your case, they have to upgrade your phone.

In order to comply with the FCC, Verizon had to upgrade more than 80% of their costumers........ I could imagine they didn't put a gun to anyone's head and ordered them to buy a new one.

Call CSR and ask to speak with a supervisor....... explain, if necessary threaten them w/ a lawsuit.

Until a week ago I had an old Motorola StarTAC, that did not have GPS capability. I received a call from Verizon Wireless last April, asking me to upgrade my phone. I refused. Only then did they tell me that I was entitled to keep using my phone and that *228 would continue to work, but only for updating roaming capabilities. However, they also said that by law they were allowed to refuse to reactivate my phone, if it were ever necessary to do so. A week ago I decided to upgrade to a V3c, and I understand that if I return it, they will probably refuse to reactivate the StarTAC. So, I did receive a warning, although I have no idea if they were accurately describing the laws.

Sorry but you will never be able to use the v60c again its just not possible to put it on the network.. verizon gets fined x amount of dollars for reactivating non gps phones and because of this they locked these esns from there network.. as soon as its taken off the system it can't go back on.. I worked fo VZW and had a similar situation to this.. I went as far up as I could go to see if I could reactivate it till I talked to one of the system engineers and they said there is absolutely no way to reactivate these phones... fortantly I was working for a franchise and we happened to have a v50i laying around you just gave the customer that one and appologised for the mix up.. verizon currently has the v60s you could probably make them give y...

I love reading these posts.

Sir your phone is old. Technology has passed you by, and I know that it still works but because of FCC rules... you won't be able to re-activate your line. If you are unhappy with your new phone, you are more then welcome to swap it out for another phone within 15 days. Seems like you still had a couple days left. I am sure you even had a NE2 (100.00 credit) cashed in also???

I have people tell me that they are going to sue VZW all the time. Like alot of very large company with a huge customer base you are bound to make some people unhappy. I am sorry that you are frustrated, but I am sure only your cousin Larry who is in his second year of night law school, won't even take your case. I laugh at people like ...

sorry norollovermin, but it looks like you are the one who needs to "get a clue" and get a life. at no point in my post did i threaten to sue VZW (that would be highly foolish, especially under the given fcc regulations and the liklihood that i probably signed away any possibility of reactivating my v60c). What i did do though was write a subject heading that read in a way to attracted attention - and it worked. fortunately others on this board responded with meaningful insight, however it also, unfortunately, drew the attention of a person such as yourself who has nothing better to do with ones time than to complain and frustrate the purpose of what should be productive message board. thanks for wasting your time, becuase with your mindset ...

Your right and I apologize.

Please remember that I hear people trying to make a quick buck, or trying to get their 15 min of fame, by trying to sue Verizon. When I saw the subject line, I kinda took offense to it. I am sure you can imagine people thinking the same thing, if someone said but out a subject line, saying they might have the next big suit against your company.

Now you are correct when you stated that you said nothing about a law suit. I went back and read it again this morning, and you do seem like a very educated customer. Again I am sorry for jumping to conclusions, and the attempt to insult your intelligence.

on top of all this you CANNOT sue vzw. its in your contract. when you sign your contract you are agreeing that anything will go to arbitration and you cannot sue vzw.

On cotrary to all who believe you cant sue the giant, you are dead wrong. I just received a letter in the mail about an ongoing class-action against VZW from customers who purchased the V710 prior to Dec 31st 2004. I am one of those customers and if the case wins in March, then I will be able to return my phone for a full refund ($335), be able to cancel my Verizon contract without any termination fee, and or be able to get a full refund of any termination fee I was already charged.

Basically Verizon touted their V710 to have full bluetooth functionality. It wasn't until later that they crippled all the V710s and future bluetooth phones and provided written description of the bluetooth features enabled. But at the time I expected all my ...

did you have your phone out when he sold you the new one. The only reason i ask is if i see someone with an old phone like that i will tell them what will happen or i will show them the fcc law that i have posted right in front of the cash register. If they don't pull their phone out i have to admit i don't always go into the computer to check what you had previously unless you give me somekind of clue you might return(such as" if i don't like this phone can i bring it back within 15 days) if you don't say anything i could probably not catch because the majority of people are upgrading becasue the hate their old phone. People usually don't upgrade if they liek their currrent phone. My best suggestion would be to call customer care and polite...

thank you for your post yearight. in response: 1. the rep knew that i had a v60 becuase i specifically told him that i purchased the phone the day it was released and that i havent purchased a new one since becuase nothing came close to its size and 2. i specifically inquired about the 15 day worry free policy, in response the rep told me about the policy and stated that he did not think that would be the case (making it as if there was no way that i would not fall in love w/ the razr). as to your point about people not usually upgrading if they like their current phone... i was working around vzw's new every 2 policy by purchasing the razr on my primary line and then switching a few esns and moving the razr to a secondary line and placing m...

I had a situation last summer where I bought a Startac on ebay & wanted to activate it on a new line. I was told no, because it was not E911 compatible. But the helpful customer service rep activated a line using a Nokia I had that did have E911 capabilities, then did a ESN swap.

Later, I needed to replace a startac on another line. I bought one on ebay and called Verizon. That rep also activated the line, saying "Hey, if your startac breaks, you should be able to replace it".

I would keep calling. If you are not happy & want to return the phone under the 15 day warrenty, they should get you back to where you were.

BTW, I have upgraded my Startac to a VC3 and I am happy.

last summer was a different story I can't remember the exact date but sometime this past fall vzw upgraded the database of esns and all non gps phones became banned from the network.. there is absolutely no way to reactivate non gps phones.. so a while VZW had a policy to not activate them but it wasn't blocked in the system but unfortantly the functionality has been removed and there is nothing that can be done

They are right. You can't put a non-gms phone back onto an account. Not because they don't want to-because the computer will not except it. But you are right in the fact that you should get a replacement phone.

Dont worry folks its not the FCC and the 911 thing anyone in washington care about its big
brother wanting to know where you are at anytime they like. and if you think the location thing with the 911 switch means anything then you also believe in the easter bunny and santa clause.
