A phone this complex has a very long development cycle, so it's as simple as the OS version was finalized before version 5 was available.
Sure they could have gone back and upgraded it, but that would have meant extra development time and all kinds of re-testing that would have pushed the release back many months. They have to have deadlines for things like that or phones would never be released.
No, it's not user-upgradeable. OS upgrades like that currently have to be created by the manufacturer for that specific device and then tested by the carrier.
I was told by Samsung that the i730 is technically upgradeable, so I assume the i830 is as well. However Samsung and Verizon have to decide whether it's worth developing and testing such and upgrade. If they do decide to do it, it takes time.
