Hmm...never had any of those problems. Are you still running windows mobile 2003 or did you upgrade to wm5? I would try upgrading to WM5 if you havent already(not going to solve your speaker issue, just to ensure you have updated software)
As for the high frequency in the phone..I have not experienced that. I would say send the thing back and get a new one if you can
