i work for best buy as the technician senior, and i deal with this issue on a daily basis.

read the service plan brochure that came with your phone. under terms and conditions it says that best buy will service or provide you with a comparible replacement as determined by best buy.

upgrading was never an option under the service plan. some stores would, however, allow you to do this because it involved the customer spending more money. corporate was not very happy about this because the company makes money from activations and not the phones themsevles. this is why they changed the policy to do exchanges exclusively through the 888 number.

if a store were to exchange your phone for you, that store is charged a fine for doing the exchange.

all best buy has done is change the way phones are exchanged to make sure they continue to make money, while keeping customers with a working phone. this is perfectly legal.
