You are right. I brought the phone in with the intention of exchanging it (for which they at first wanted a $35 restocking fee 
). They recognized that it was broken, but it turned out to be an easy fix:
There is a plastic cover on the main hinge of the phone which covers up a small screw. On my phone, the cover had been dislodged and was hanging out, getting in the way every time the phone closed and pushing it back apart. By fixing the cover in place the phone was able to fold just fine.
