when you purchased it did you do the IVR or did they do that for you when you got it? (the IVR is the automated contract acceptance whenever you get a new phone)
after that is done you can txt and call but data services will not work until you have powercycled.

2. did you put on a medianet package?
and if all else fails
1. call customer service
2. take it back and try another, or try putting your SIM in another at&t phone to make sure the data features work on that as well
