Spec wise, the 8GB N95 kills the iPhone, but it's twice as expensive (note the 8GB iPhone retails for $399.00). And plus, there is nothing over the top unique about the N95.

The iPhone doesn't retail for $399, it is available for $399 with a two-year plan from AT&T.

your not obligated to activate, you can activate it whenever you want, OOOHH and you can use it on prepaid, so there is no contract

Can you please post any sources which confirm your statements? As far as I know, the only way to use th iPhone is a two-year contract with AT&T - no other options are available, no 1-year contract, no prepaid.

Of course, if you manage to unlock the phone, then you don't have to activate it and get the two-year contract, but we are talking about the general phone user...

I am an AT&T employee and what pennyless said is true you are not obligated to activate the iphone, you can activate it whenever you want, and you can use it on prepaid, so there is no contract which is why wether you have a 2 year contract or not it is $399.99
...

You can use it on Pick Your Plan, not Pay-As-You Go Pre Paid plans.
