While I understand your situation, and I know that the Big Red does tend to stretch the truth and tell white lies (but let's be honest, ALL carriers do that), but I fail to see how they breached the contract.

It's their phone before they sell it to you. They make the choice as to what applications and programs the phone will be able to access through their network. They reserve the right to block any access to any website or program they choose to.

That's why you have a 30 day return period with VZW. It took you more than 30 days to figure out that you wanted to use the GPS on the phone? Seriously?

You had every opportunity to look at services and ask questions before you made any choices. Seriously, you KNEW you wanted GPS because your 6800 couldn't do it. You bought the Omnia because the guy said it had GPS... so why did it take you more than 30 days to try to use it?

Unless you're still within your 30 day return period, then why not just return the phone and quit complaining about it?

I'm not trying to be a jerk or anything, I just don't see how you can possibly think they're breaching the contract when they reserve the right to block 3rd party applications.
