T-Mobile Slapped With Class Action Suit

T-Mobile subscribers have filed a class action lawsuit against the company over charges for unwanted text messages. The lawsuit contends that T-Mobile does not allow customers to prevent text messages from being sent or received from their mobile phones, and charges the customers for messages even if the customer doesn't want them. One of the litigants claims T-Mobile refused to turn off the text messaging feature on her phone. T-Mobile didn't respond to the lawsuit. Sprint and Verizon Wireless allow customers to disable text messaging features.

Now THIS lawsuit has some merit

And not just because I sell the Big Red. But the suit against VZW doesn't seem to have merit because it's a bunch of customers whining about not getting their prorated ETFs because VZW added that feature after they quit. But VZW allows text blocking, email text blocking, and premium sms blocking, ATT offers text blocking and still allows administrative texts (a feature I wish VZW had), but Tmob doesn't allow text blocking at all.

If you can't block the feature, it should either be free, or every customer should get even 10-20 free messages a month just to cover incidentals, unwanted messages, and spam.
I sell T-mobile and often have been asked about turning texting off ... they are always dismayed when I state that t-mobile does not do text-blocking.

I have only offered a few suggestions

1) Tell the people texting not to text
2) make the peop...

This law suit hardly has anything to do with people getting spammed; in fact, customer care normally will help out a customer on removing oneself from these lists.

Domino Effect

That's what happens when you try to rock the boat it creates ripples.
I completely agree. Carriers should have left it at .10 outgoing and .02 incoming. Now they will have to sink thousands to create systems for their pay per usage.

I personally would love to see a CAL that requires carriers to give free incoming...

Text Blocking

Interesting, when I first signed up with T-Mobile 3 years ago I was receiving tons of spam texts, I called them and requested them to block them and they said "no problem". I have not received a spam text since.

That wouldnt be intelligent bill. Sprint would be the way to go in regards to spectrum, you should just buy sprint.

👿 👿 👿 no not really, i hate it, if you dont like text messages beeing charged to you, then tell your friends to quit texting you, some people just love to sue for anything, im surprised those people didnt sue their parents for giving them life, or maybe they have tried....
You get charged for spam text messages too, and you can't control those. It's not nearly as simple as you're trying to make it sound.

T-Mobile does not allow you to disable text because this is how they contact you. For welcome messages, bill updates, phone number changes, vm resets and much more. And all of these are free.

If people are getting spam then they need to stop adding there mobile number to all the webs they go to. And if they are getting daily jokes or ringtones and such they should have not watched that commercial and sent the first text.

As you kids, not T-Mobiles fault your kids dont listen to you. Get a handle on them and if they wont stop take away phone, or add 9.99 feature for unlimited text instead of whinning about hundreds dollars in overage.

Useless lawsuits just hurt everyone. Man another stupid lawsuit I need to pay for... For what so yo...

I can't speak for the other carriers, but AT&T has a specific code that blocks all SMS - but still allows administrative SMS to come in (PLM UPdates, Voicemail indicators, * services). I can't see how difficult it would be for T-mob to set this up.

I will agree with you for now - but Tmobile (actually, the industry itself) needs to implement a SPAM feature on their TEXT messaging front.

I dont think people are seeing eye to eye...

Not ALL spam messages are from people giving out their mobile so freely. Stop lashing out at people for this, as it doesn't apply is all cases. Did it every occur to you that some of the spam is from the mobile numbers being recycled? The spam messages could originate from the previous subscriber or the subscriber before them. Chill out....

Did't T-Mobile got sued for something else recently and lost?

I got a letter a few months ago from a law firm saying i was entitled to some money from TMO. The amount was pretty small so i just trashed it. The bottom line is, don't do things (like screwing your customers) and you will not get sued.

If i get a phone call from a number i don't recoqnize, i don't answer. Maybe there should be a system that only if you open and read the message then you get charged. BUT WHATEVER. I have a messaging plan and i an not even close to my limit, so does not affect me.
