Nokia N97 Windows Mobile CLONE question

There are new Nokia N97 clones with Windows Mobile 6.1 on it.

I see other clones with Windows Mobile 6.5.
This has "windows mobile 6.1". I was wondering, if it is windows mobile, would one be able to upgrade from 6.1 to 6.5?
