Top message: Supreme Court will tackle same-sex marriage by LegitSmushmortion
Replying to: Did they really? by Candall
It essentially gives Congress power to regulate things that they shouldn't really have any say in to begin with. Granted, some anvils needed to be dropped, but the main issue that should be going to the Supreme Court isn't whether gay marriage should be allowed, it should be whether the states that don't currently recognize homosexual unions have the right to disregard another state's marriage laws.
As in, should a state say that no homosexual unions are recognized, even though a resident couple had previously married under another jurisdiction, or should said couple still be covered as married under the law?
