Unfortunately, no. The carriers in the US require a data plan for a smartphone, mostly because the phone won't have any features that function without data. They might sell you a phone at full retail cost, but if you want to activate it on their network, they will require the data plan.
The only reason I can think of is, they sold a smartphone and want to make more money off that device while it's being used.
