The fee is only if you get a phone, you like the network, but you want a different phone (and it ISN'T because the phone sucks, but you just want a different model). If a phone is returned and it has over a certain amount of talk time, it CANNOT be sold as new, and must be sold instead as a refurb or a warranty replacement. That is a huge loss the company is taking (much more than $35) for someone who just wants a different phone.
If you hate the service, or if the phone is defective, you don't have to pay this cost.
