On T-Mobile's network, and on every other one I've seen, the name does have to be the same to transfer a number from one name to another. The possibilities of fraud are far to great for this to be possible. If it can be transferred to a different name, people can possibly accept/transfer responsibility without proper documentation. The bill is requested to make sure all the information on the acct is correct. For instance, if there is a middle name on your old AT&T service, but not one on your new T-Mobile account you're trying to create, the number transfer won't go through. I know this is true because I deal with it on a daily basis.
