Class action/6101

I'm seriously thinking about starting a class action lawsuit against T-Mobile for selling a defective phone (Nokia 6101). This phone has bugs that should have been discovered during T-Mobile tests.

If anyone has the 6101 and is frustrated with the bugs please reply to this post.

Just in case you weren't familiar with the way class actions usually work the attorneys get pretty much all the money and the end user is lucky if they get a few cents. It may also mean that other costs the company incurs will be passed on to you.

That's funny. After I keep hearing how great Nokias are and you want to sue T-Mobile for selling what by apparant track record should have been a solid phone. And of course, so far, I have heard one complaint against the Nokia in question and over 20 plus compliments.

🤣 let me tell you about a little thing called "mandatory arbitration" you might remember it while reading the contract that you signed when starting service. Basically it means that you can NOT sue tmobile for whatever reason. You will have to go to a sort of small claims court with officials assigned by tmobile....so good luck on that johny ****rine (Sp?)

To answer everyones questions....

The contract that I signed was for 12 months and is already expired.

The bugs that I have found are as follows..

1) The phone turns off when using voice commands (not voice dialing, but voice commands) and this happens at least 3 times a day.

2) No matter what ring setting I pick my ring tones are ALWAYS ascending, so by the time I actually hear the phone ringing the phone forwards to voice mail

3) Whenever I have more than 50 text msgs in my inbox the phone freezes, and this is not a memory issue, because i have plenty of free memory.

4) After sending a picture message my screen size will shrink and i get a white border around the screen, and it will stay there until I do a power cycle.

contact nokia....quit threatening legal action or youll gain the silent treatment from tmobile

I have contacted Nokia, and I was told I could send in my phone for repair, but as far as bugs go they only accept reports from carriers.

if you even mention you want to sue T-Mobile to a custumer service representative they will transfer you to our legal department and custumer service reps will be forbiden to talk to you. That will be noted on your account.

I'm going to sue Comcast because my Sharp TV sucks.

Then I'm going to sue my waitress because the cook screwed up my order.

Oh, and then I'm going to go and sue Sirius because my Delphi reciever has a software issue.

Yes, I am an idiot. Because I intend to sue a service provider for something they didn't manufacture. Which is precisely what you're suggesting. Furthermore, I don't believe you even know what a class action law suit is. In such a case, there would have to be proof that a company intentionally defrauded a market segment regarding its product. Now the only thing you're missing is the "intentionally defrauded" part, the "Market segment" part, and the "its product" part. You are not a market segment, the product is not T-Mobile's, and nothing was done to intentionally defraud you or anyone else. Consumer Law classes are available at your local community college.

Why waste your time and money? It will be cheaper to pay the 200 dollar ETF than to pay the outstanding lawyer fees in court AND still lose to T-Mobile. Just switch to Cingular or Verizon and move on with your life. It is JUST A CELL PHONE! It is not like T-Mobile sold you a defective pacemaker!

It's oh so easy to tear into this guy since you are not having problems with *your* phone. I'm sure you'd sing an entirely different tune if this happened to you!

If I was sold a defective phone I would send it back. If you read people's phone reviews they had defective phones from T-Mobile and T-Mobile replaced the phones. I think it is rediculous that someone wants to sue over a silly cell phone!

By the way I never have problems with my phone. It is a nokia candy bar style phone. I bought the 3120 from Cingular.com and unlocked it for T-Mobile. And if it did not work properly I would have contacted Cingular and see if I could get it replaced. I only spent 30 dollars on it. I also think it is foolish to spend over 100 dollars on a phone.

You really need to settle down. I used the 6010 as an example of a cheap phone. I was commenting that people get what they want and sometimes that means that they're going to buy a phone that's over $100 and sometimes they're going to get the cheap or free phone. You evidently haven't been paying attention to all the buzz the V3 Razr has generated. That phone was well over $100 when it came out and still is for the most part. And just for your information the 6010 does not "suck" for everyone. It may suck for you but some people think it works quite nicely for them. You are not e...

alright everyone......pull your diapers back up.....cellphones are electronics. Chances are the phone may actually be defective and a simple call to customer care would easily have it taken care of -OR- your one of the typical idiots I see everyday that wet they're pants when they're phone isn't working (translation: ......i see everyday that wet they're pants because they are too ***n stupid to understand how to use they're phone and have to immediately run down to the nearest t-mobile store and bitch out an associate.

so u have a defective phone. who hasnt. i am on my 8th motorola this year. my a630 didnt even last me 6 months and i currently have a v330 and i am on my 3rd on as well. phones are not made to be perfect. u are going to gets problems here and there. technology is not perfect either.

To reply to everyone....

1) I have already done 2 handset exchanges (thats 3 brand new phones)

2) If I decide to leave Tmobile there is no way in hell I'm paying an ETF.

3) If I do decide to take legal action there is no way I'm going to call T-mobile and warn them first, I would just do it.

4) It *IS* just a cell phone, but if your phone turned off or restart 3-4 times a day I'm sure you all would be singing a different tune.

Reading the posts, you won't get too much support here. I also have the 6101 and LOVE it. The only buggy thing it does is once in a while, if I try to delete, it says it can't. I try again and it does it. Not a big deal to me. I haven't experienced ANYTHING that you described. Most phones do have some little bugs/glitches. I'm sorry you've had such a hard time. The biggest reason I said you must be crazy is because my reps on my team (I am a sup at tmobile customer care) hardly ever tell me about problems that their customers are having. I always hear about Moto's and that god-awful Siemens piece of crap and I hear about Samsungs more and more. Hardly EVER hear a complaint about Nokia though.

It surprised me too... I'm a big fan of Nokia, I've always had Nokia's.

Nokia 5190 - great phone
Nokia 3390 - great phone
Nokia 3595 - ****ty phone
Nokia 6610 - great phone
Nokia 6101 - I'm still not 100% sure yet.

So tell me, what do you think I should do? I've already had 2 handset exchanges.

Well let me ask you first...what kind of bugs does the phone have? Some of the bugs simply might be how the phone is manufactured and this is how it was designed.
I know that my phone has a little bit of a slow processor where there is a 3-5 sec delay when pulling up memos or switching screens. I think that is just how the phone is manu'd.
Let me know exactly what kind of probs and I'll see what would be the most prudent action. It's really a great phone!
