I am a Legacy AT&T person, with my same working number on my older Nokia 6360.
My last contact with AT&T Wireless (a 2 year) ended October 2003.
I am on a month to month $39 plan, and I always carry a credit balance on my billing.
(Cingular owes me $50)

My Goals are;
A new phone (Nokia 6230), at something less than retail.
And, I am willing to sign a contract, but prefer only a 1 year.

I called Cingular, and this was their response.

I do not qualify for any phone upgrade discounts, because I am not in the 10th or 22nd month of an existing contract.

I can not sign a contract extension, with discounts, because I do not have a contract.

I can not leave Cingular without incurring an Early Termination Fee, as I have an assume...

This sounds mysteriously wrong. I would call back and try another rep. Apparently the rep you talked to didn't even know for what company he was working for. Believe me on this... If you have been out of contract since 2003, you should be able to MIGRATE (make sure you use this word) and get a new cell phone with a 1 yr contract. You will pay a little more for the phone -cuz of the 1 yr contract- but you'll have a newer phone and probably a much better plan with rollover.

He should also be certain hes calling Legacy AT&T Wireless TDMA care... He may have had some Cingular rep pulling things from their rear end.

Does anyone else think that some reps just look at the CA area code and start saying all of this without actually checking the migration tool. I had 3 reps do it to me today...they are in CA so they cant migrate what do I tell them? My answer is the same everytime...did you actually check?

You'll be able to migrate with a dicount that comes with a 1 year contract

Yeah, assuming you are out of contract you can 'migrate over' with no penalty and discounted pricing on the phones depending on the contract you agree to. Or if for some reason you had a 2 yr, if you are in at least month '21' of 24 you can migrate over with the discounted pricing.

To be honest with you lostandconfused,

They are all right about the being able to migrate part, but the difference of the price of the phone from a 1 year to retail is only $50. If I were you, I would just buy it retail and forgo the contract.

Except you can't get the free MTM on a no contract plan. Gotta do at least a one year for that option.

If MTM isn't a worry then go for it.

As far as I have been advised Cingular Migration team processes on 2 year contracts, Former AT&T wireless at one year contracts, if you're a business customer.
